These Terms & Conditions apply when you use The Urban Art Dealer website or purchase products from us.Please read these Terms carefully before placing an order. By placing an order through our website, you agree to these Terms & Conditions.Nothing in these Terms affects your statutory rights as a consumer.
2. ABOUT THE URBAN ART DEALER & THE URBAN RASCALS
The Urban Art Dealer is an independent art, design and lifestyle business.We sell a mixture of:Products designed, created or commissioned by The Urban Art Dealer;Products sold under The Urban Rascals, our children's brand;Original and limited-edition artwork;Prints, art toys and collectibles;Handmade and artist-produced pieces;Clothing, caps and accessories;Cards, stickers and other printed products; andSelected products, artwork and collectibles independently sourced from other artists, brands and creators for resale.The Urban Rascals is a brand created and operated by The Urban Art Dealer and is not a separate seller. Purchases of The Urban Rascals products are therefore purchases from The Urban Art Dealer and are subject to these Terms & Conditions and our Returns & Refunds Policy.In these Terms, references to "we", "us" and "our" mean The Urban Art Dealer.
3. USING OUR WEBSITE
You may use our website for lawful purposes and to browse and purchase our products.You must not misuse the website, attempt to interfere with its operation or security, introduce malicious software, attempt to gain unauthorised access to the website or use the website for fraudulent or unlawful purposes.We may restrict or suspend access to the website where reasonably necessary for maintenance, security, suspected fraud, misuse or other legitimate business reasons.We may also update, change or remove website content or features from time to time.
4. PRODUCTS
We make reasonable efforts to describe and photograph our products accurately.However, colours can appear differently depending on the screen, device and display settings you are using.Measurements and dimensions provided on product pages are intended to be as accurate as reasonably possible, but small variations may occur, particularly with handmade products, clothing and artist-produced pieces.Packaging may also occasionally differ from photographs shown on the website.
Handmade & Artist-Produced Products
Many of the products we sell are handmade, hand-finished, hand-printed or artist-produced.This means individual products may contain natural variations.For example, hand-pulled screen prints may contain small print artefacts, differences in ink coverage or registration, while hand-painted toys and objects may contain brush marks, paint overlaps and other characteristics of the artist's process.These characteristics are part of the nature of handmade and artist-produced work and are not necessarily faults.Any significant damage or condition issues relating to a particular original, collectible, vintage or resale item will be described or photographed as accurately as reasonably possible on the relevant product listing.Nothing in this section affects your rights where goods are genuinely faulty, damaged, misdescribed or not of satisfactory quality.
5. ORIGINALS, LIMITED EDITIONS, COLLECTIBLES & RESALE ITEMS
Some products sold by The Urban Art Dealer are originals, limited editions, discontinued products, collectibles, vintage items or one-off pieces that we have independently sourced for resale.Availability can therefore be extremely limited and, once sold, an identical replacement may not be available.Where a limited-edition number, artist, edition size, signature, certificate or other important characteristic forms part of the product description, we will make reasonable efforts to provide accurate information.Unless expressly stated otherwise, purchasing an artwork, print or collectible gives you ownership of the physical item only. It does not transfer copyright, reproduction rights or other intellectual property rights in the artwork or design.
Independent Resale & Artist Disclaimer
The Urban Art Dealer is an independent seller and collector of art, prints, collectibles and related products.
Unless expressly stated otherwise, The Urban Art Dealer is not affiliated with, endorsed by, sponsored by, an authorised dealer for, or a representative or agent of any artist, designer, brand, gallery or other creator whose work appears on this website.
We independently source, purchase and resell artworks and collectibles that we choose to make available through The Urban Art Dealer.
Artist, designer, gallery and brand names are used where appropriate to accurately identify and describe the creator, manufacturer, publisher or origin of products offered for sale. Their use does not imply any affiliation with or endorsement of The Urban Art Dealer.
Copyright, trade marks and other intellectual property rights in third-party artworks, designs, names and brands remain the property of their respective rights holders. Nothing on this website is intended to claim ownership of those third-party rights.
The sale or advertisement of a third-party artwork or collectible by The Urban Art Dealer does not imply any commercial relationship, partnership, endorsement, representation or association between The Urban Art Dealer and the artist, creator or relevant rights holder unless expressly stated on the relevant product listing.
This does not affect our responsibility to accurately describe the products we offer for sale.
6. THE URBAN ART DEALER & THE URBAN RASCALS PRODUCTS
Products sold under The Urban Art Dealer and The Urban Rascals brands may be designed by us and manufactured, printed or produced either directly by us or with the assistance of specialist manufacturers, printers or production partners.Minor differences can occur between production runs, including variations in colour, print position, materials, finish and sizing.Where appropriate, product-specific information, materials, sizing and care instructions will be provided on the relevant product page or with the product.
7. CLOTHING & SIZING
Please check the sizing information provided on the relevant product page before ordering clothing.Sizing can vary between different garments, manufacturers, styles and production runs.Any measurements provided are intended as a guide and reasonable manufacturing tolerances may occur.Please follow any washing and care instructions supplied with clothing. We cannot accept responsibility for damage caused by failure to follow care instructions, misuse or normal wear and tear.Your statutory rights in relation to faulty products are not affected.
8. PLACING AN ORDER
When you place an order through our website, you are making an offer to purchase the products in your basket.You will normally receive an automated email confirming that we have received your order.This acknowledgement does not necessarily mean that we have accepted your order.A contract for the purchase of the goods is formed when we accept your order, normally when the order is confirmed for fulfilment or dispatched.We reserve the right not to accept or to cancel an order before dispatch where there is a legitimate reason to do so, including:A product being unavailable;
-- An obvious pricing or product-description error;Payment not being authorised;Suspected fraud or misuse;An incorrect delivery restriction or shipping issue; orCircumstances outside our reasonable control.If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
9. AVAILABILITY
All products are subject to availability.This is particularly important for original artwork, limited editions, one-off pieces and collectibles.Occasionally an item may become unavailable after an order has been placed, for example because of a stock error or because a unique item has been sold through another sales channel.If this happens, we will contact you and refund any amount paid for the unavailable item.
10. PRICES & PAYMENT
Unless stated otherwise, prices on our website are displayed in Pounds Sterling (GBP).Delivery charges and any other applicable costs will be shown before you complete your purchase.We may change our prices at any time, but changes will not normally affect orders that we have already accepted.We take reasonable care to ensure prices are correct. However, errors can occasionally occur.If we discover an obvious pricing error before your order has been accepted or dispatched, we may contact you to give you the option of purchasing the product at the correct price or cancelling the order for a full refund.Payment must be successfully authorised before an order can be processed.The payment methods currently available will be displayed during checkout and may change from time to time.Where payment is made using a third-party payment or finance provider, such as a buy-now-pay-later service, additional terms from that provider may also apply.
11. DISCOUNT CODES & PROMOTIONS
From time to time we may offer promotional codes, discounts or special offers.Unless otherwise stated, promotional codes cannot be exchanged for cash, cannot be used retrospectively on previous orders and cannot normally be combined with other offers.Additional conditions or expiry dates may apply to individual promotions and will be stated when the promotion is offered.We reserve the right to withdraw or correct a promotion where there has been an obvious error, misuse or fraud.
12. PRE-ORDERS & MADE-TO-ORDER PRODUCTS
Certain products may occasionally be offered for pre-order or made to order.Where this applies, it will be clearly stated on the product page together with an estimated dispatch or availability timeframe where possible.Any dates provided for pre-order or made-to-order products are estimates unless expressly stated otherwise.Production delays can occasionally occur. If there is a significant delay, we will provide updated information where reasonably possible.Your cancellation and consumer rights will continue to apply in accordance with applicable law.
13. PERSONALISED & CUSTOM PRODUCTS
Some products may be personalised or made specifically to a customer's requirements.Please check all names, wording, images, sizes, colours and other customisation details carefully before submitting your order.We are not responsible for errors in information or content supplied or approved by the customer, unless the finished product does not match what was ordered.Certain personalised or genuinely custom-made products may not qualify for change-of-mind cancellation rights.This does not affect your statutory rights if a personalised or custom-made product is faulty, damaged, not as described or has been made incorrectly.
14. DELIVERY
We aim to prepare and dispatch orders within the timeframe shown on our website or product listing.Any dispatch or delivery dates provided are estimates unless expressly stated otherwise.Delivery times can vary depending on the destination, delivery service, product and circumstances outside our reasonable control.If there is a significant problem or delay with your order, please contact us and we will investigate.We will deal with lost or damaged orders in accordance with applicable consumer law and our Returns & Refunds Policy.
15. DELIVERY ADDRESS
Customers are responsible for providing a complete and accurate delivery address when placing an order.If you notice an error in your delivery address, please contact us as quickly as possible.We cannot guarantee that an address can be changed once an order has entered the dispatch process.Additional delivery costs may apply where an order has to be resent because an incorrect or incomplete address was supplied by the customer, where permitted by law.
16. INTERNATIONAL ORDERS
Where international delivery is available, customers are responsible for checking whether products can legally be imported into their destination country.International orders may be subject to local customs procedures, import duties, taxes or handling charges.Where these charges are not collected by us at checkout, they may be payable by the recipient directly to the relevant authority or delivery provider.Customs processes can also cause delivery delays outside our control.Nothing in this section limits any rights you may have under applicable consumer law.
17. RETURNS, CANCELLATIONS & REFUNDS

18. DAMAGED OR FAULTY PRODUCTS
If a product arrives damaged, is faulty, is not as described or you receive the wrong item, please contact us as soon as reasonably possible.Photographs of the product and packaging can be extremely helpful when investigating damage, particularly where an item has been damaged during delivery.Where possible, please photograph visibly damaged packaging before opening the parcel.Any request for photographs is intended to help us investigate and resolve the issue and does not remove or limit your statutory rights.Depending on the circumstances and your legal rights, an appropriate remedy may include a refund, repair or replacement.For originals, one-offs and sold-out limited editions, an identical replacement may not be possible.
19. INTELLECTUAL PROPERTY
The Urban Art Dealer creates original artwork, designs, illustrations, graphics, branding, photographs and other creative material.Unless otherwise stated, content created by or for The Urban Art Dealer and displayed on our website or products remains the intellectual property of The Urban Art Dealer or the relevant rights holder.This includes The Urban Art Dealer and The Urban Rascals branding and original designs created for those brands.You may not copy, reproduce, modify, manufacture from, commercially exploit, sell, distribute or use our artwork, designs, photographs, graphics or other protected material without permission from the relevant rights holder.Purchasing one of our products does not transfer copyright, reproduction rights or commercial usage rights to the purchaser.
Artwork & Products From Other Artists
The Urban Art Dealer also sells artwork and products created by independent artists, designers and brands.Copyright and other intellectual property rights in those works remain with their respective creators or rights holders unless expressly stated otherwise.The Urban Art Dealer does not claim ownership of intellectual property belonging to the artists, designers or brands whose legitimate products we resell.Our use of an artist's, designer's or brand's name in connection with a resale product is for the purpose of identifying and describing that product and does not imply affiliation, endorsement or representation.
20. PRODUCT IMAGES & SOCIAL MEDIA
Photographs and images appearing on our website and social media may be protected by copyright and must not be reproduced or used commercially without permission.If you tag The Urban Art Dealer or The Urban Rascals in photographs or content featuring our products, we may contact you to ask for permission to share or repost that content.We will not treat tagging us alone as transferring ownership of your content to us.
21. PRIVACY & PERSONAL INFORMATION
We handle personal information in accordance with our Privacy Policy.Our Privacy Policy explains what information we collect, why we collect it, how it is used and your rights regarding your personal information.Payment information may be processed by third-party payment providers. We do not necessarily receive or store your complete payment-card information.
22. OUR RESPONSIBILITY TO YOU
We do not exclude or limit liability where it would be unlawful to do so.Nothing in these Terms excludes or limits your statutory rights as a consumer or our liability for matters that cannot legally be excluded or restricted.We are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses resulting from circumstances outside our reasonable control, except where the law provides otherwise.Products purchased by consumers are intended for personal use unless otherwise stated. We are not responsible for business losses arising from a consumer purchase where such losses were not reasonably foreseeable.
23. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delays or failure to perform our obligations where caused by events outside our reasonable control.These may include severe weather, postal or courier disruption, strikes, transport disruption, supplier or manufacturing delays, natural disasters, government restrictions or widespread technical failures.Where such an event affects an order, we will take reasonable steps to minimise the impact and will contact affected customers where appropriate.Your statutory rights are not affected.

Our website may contain links to third-party websites or use services provided by third parties, including payment providers, delivery companies and social media platforms.We are not responsible for the content or operation of third-party websites that we do not control.Where you choose to use a third-party service, that provider's own terms and privacy policies may also apply.
